TERMS AND CONDITIONS

Terms of Service for AAA Limousines, Select Chauffeurs and Bridal Wedding Cars.



1st January 2022.


In these Terms and Conditions (Terms):


We, Us and Select Chauffeurs mean Select Chauffeurs Pty Ltd ABN 98 154 624 772 and all
associated companies, staff, and chauffeurs.


Client, You and Your mean the individual/s, company or other entity making a reservation, and/or
any representative or guest thereof.


1. When these Terms and Conditions apply


1.1 Application of Terms and Conditions


Your booking is accepted subject to the following terms and conditions. By confirming your
booking, you accept that these terms & conditions will apply.


These Terms and Conditions cannot be varied by any of our employees, agents or other personnel or
representatives.


However, this does not affect our right to waive any fare rule or amount payable. A waiver on one
occasion does not constitute a waiver on any other occasion.


We (Select Chauffeurs Pty Ltd, Buses Coaches & Limousines) provide ground transport services
throughout Australia via the combined fleets of Select Chauffeurs Pty Ltd Buses Coaches &
Limousines.


From time to time, transport services may be provided by a Select Chauffeurs Pty Ltd partner that
meets our quality control standards.


1.2 The Australian Consumer Law


These Terms and Conditions do not limit certain guarantees and rights for consumers that exist
under the Australian Consumer Law, as contained in Schedule 2 of the Competition and Consumer
Act 2010 (Cth).


Services provided in Australia (including our services) come with the following consumer
guarantees that cannot be excluded under the Australian Consumer Law:


• Guarantee as to due care and skill;
• Guarantee as to fitness for a particular purpose; and
• Guarantee as to reasonable time for supply (if no time is specified).


Where we fail to provide services to you in accordance with these consumer guarantees, you may
have a right to seek a remedy in accordance with the Australian Consumer Law.


2. Quotation/Validity


Prices are current at the time of quotation and subject to availability at the time of booking. All
quoted prices include GST.Notwithstanding the quoted price, any increases that may occur in any applicable charges such as
airport charges, road tolls, entry fees or parking charges will be payable by you.


Unless otherwise specified, our offer to supply services is open for acceptance within 30 days from
the date at which it is established. After this date the offer is no longer capable of being accepted by
you.

3.1 All bookings are subject to availability at the time of reservation. For operational reasons we
reserve the right to substitute vehicles of similar category or capacity, where necessary.


3.2 Select Chauffeurs Buses and Limousines reserves the right to cancel bookings, amend fares,
itineraries, days and times of operation of services offered upon reasonable notice to the extent
possible and otherwise as soon as is reasonably practicable (except in an emergency). The Client is
responsible for confirming availability.


3. Deposit and Final Payment


The following terms apply with respect to payment for bookings:


• For customers who do not have a credit account with Select Chauffeurs Pty Ltd – payment of a
deposit to the value of 25% of the booking price is required in order to confirm the booking. The balance

of any amount due must be paid no later than 7 days prior to the date of travel.


• For customers with a credit account with Select Chauffeurs Pty Ltd – if the booking price exceeds
your approved credit limit, you must pay a deposit to the value of the difference in price between

the booking price and your approved credit limit. Where the price of the booking or multiple bookings

in the same period do not exceed the approved credit limit, no deposit is payable.


• For international customers (customers located outside of Australia) – full payment of the booking
price is required no later than 14 days prior to the date of travel.

4. Charges (including Airport Parking, Tollways, Parking Fees and National Park entry)


Airport Parking and Toll Fees are included in Coach Rates where applicable. However, additional
Parking and Toll Fees are NOT included in City-City Touring Rates and will be charged in addition
if used in your itinerary.


You can request a booking confirmation to include charges (for any charges that are not included in
Coach Rates).


Please note that these charges are indicative only and do not constitute the invoice and do not
override any negotiated rate. The final price for charges will be the total of all charges incurred to
complete the tour as requested.Tolls and Parking are governed by the relevant State Authorities and

these charges are subject to change without notice.


National Park entry fees are not included in the Coach Rates. Should your itinerary require entry to
any National Park and we incur costs for that entry, you will pay for all National Park entry fees
incurred.


Any newly introduced third party charges and any increases in statutory charges or taxes such as
New Tollways, Airport Parking Fees, GST, Carbon Tax or any other third-party fees introduced in the

effective period, will be payable by you.


5. Payment


If you choose to pay via credit card, the following fees will apply:


• Visa/MasterCard – 1.33% of transaction value


• American Express and JCB - 2.82% of transaction value


• Diners – 3.23% of transaction value


6. Amendments to Bookings


Any amendment to your booking after confirmation can only be accepted subject to availability.
Requests for amendments must be made in writing and will be confirmed by us in writing.


We reserve the right to charge an amendment fee (up to $50 unless substantial change management
is required) in respect of any change to your booking in addition to any other applicable charges in relation to the
amendment (such as road tolls).


Once confirmed, your reservation price will not change unless you change the details of your
booking or extend your time/s. Should you need to modify transport times, routes or dates, please
advise us in writing. Every effort will be made to accommodate your request but we cannot
guarantee to be able to do so.


You have the right to cancel your reservation subject to our cancellation policy.


Chauffeurs DO NOT have the authority to alter the booked times, pick up or destination addresses
or routes without the prior consent of our fleet manager.


“No-Show”


To ensure the dependability of our service, it is necessary to reserve and dispatch a specific car and
chauffeur to meet each Client. It is therefore necessary to charge for the service (as a hotel must
charge for a guaranteed room) in the event the passenger is a "no show".


You can avoid the "no show" charge by giving us a call before the chauffeur is dispatched.


International bookings require 24 hours’ notice prior to the booked time. A “no-show” will be
charged the total amount of the confirmed fee if you do not “present” at the nominated time and
place.


7. Extensions to Bookings


Where you choose to extend the duration of your booking, any additional charges will be payable
by you. This may include charges levied by venue or accommodation providers or charges for flight
changes.


8. Cancellations to Bookings


In the event that you are unable to proceed with your booking or change your mind, we do not offer
refunds or credits.


We reserve the right to charge a cancellation fee as follows:


• Bookings cancelled greater than 5 days prior to travel: up to 25% of the value of the booking


• Bookings cancelled between 5 days prior to travel and the day of travel, but not on the day of
travel: up to 50% of the value of the booking


• Bookings cancelled on the day of travel: up to 100% of the value of the booking


• In all cases the total fee charged will not exceed the value of the booking.


• In addition to any cancellation fee charged by us, you will also be responsible for payment of any
cancellation fees or charges levied by third parties (such as venue or accommodation providers) that
may be relevant to your booking.


9. Conduct during Travel


9.1 Dress Standards


We require all passengers to conform to minimum dress standards on any service which includes a
shirt, shorts/trousers/skirt, and footwear.


9.2 Food and Beverages


Food & Beverages are not to be consumed on any vehicle without prior written approval. In such
circumstances payment of a bond may be required to cover the risk of damage to the vehicle. Your
responsibility for any damage is in accordance with these terms and conditions.


Smoking is not permitted by law on any of our vehicles.


9.3 Storage


We do not offer refrigerated bulk storage for carriage of bulk quantities of plant or animal products
including any food items.


Due to concerns around hygiene, disease, vermin and other passenger comfort, we do not allow the


carriage of bulk quantities of food stuffs in any form. For the avoidance of doubt, bulk quantities

will be reasonably assessed as a quantity exceeding what you may reasonably consume on an
individual service or trip.


10. Luggage


10.1 Responsibility for Luggage


You are responsible for all luggage, carry-on luggage and personal items. We accept no
responsibility and will not be liable for any damage to (unless the damage was caused by our
negligence at no fault by the passenger), theft or loss of any luggage whilst on our premises
including when on board a vehicle.


10.2 Prohibited Items


We may refuse carriage of any luggage if we reasonably believe that the luggage is:


• Unsafe;


• A hazardous substance or dangerous good;


• Likely to be damaged during travel; or


• Likely to cause damage to other passenger luggage or any other property.


• In the event we refuse to carry luggage, you hold sole responsibility for any and all costs of
alternate travel for them luggage.


10.3 Unclaimed Luggage


If a passenger leaves an item of luggage on one of our vehicles:


• We will make all reasonable efforts to identify the owner of the luggage and notify them of the
unclaimed luggage.


Collection of the luggage will be the sole responsibility of the passenger.


• Any freight fees incurred in transporting the luggage to an alternate location will be borne solely
by the passenger. We will store the item as lost property for a period of 90 days. Should the item
remain unclaimed at the expiry of that storage period, the item will be disposed of at our sole
discretion.


• We will not be liable for any loss, expense or inconvenience incurred by the passenger.


11. Scheduling


We will use our best efforts to arrive, depart and get to your destination by the scheduled times.


However, our ability to provide timely and safe travel services is highly dependent on many factors that exist beyond our
reasonable control. For this reason, we do not guarantee that we will depart or arrive at the specified
times when you make your booking.


We recommend that when making travel plans, you ensure that you allow enough time for
contingencies and obtain insurance to allow for any unexpected disruptions.


12. Liability


Under the Australian Consumer Law, you may be entitled to a remedy for breach of consumer
guarantees (for example, resulting from delays and cancellations). Factors that may be relevant in
this regard include the reason for any delay or cancellation, the length of any delay, any advance
notice of the delay that was provided to you, and whether we remedied
the delay or cancellation, for example by arranging a replacement vehicle within a reasonable time
(depending on the circumstances).


Our liability in respect of breaches of consumer guarantees is limited to:


• The supply of the services again; or


• The payment of the cost of having the services supplied again.


To the extent permitted by law (including the Australian Consumer Law), you are responsible for
any additional costs or expenses (including charges from third parties) in the event that your
booking does not run to schedule.


Where services from third parties (such as venue or accommodation providers) form part of your
booking, you will be subject to the terms and conditions of those third parties with respect to those
services. To the extent permitted by law (Including the Australian Consumer Law), we have no liability for any loss or damage occasioned
by the negligence, act or omission of any third party (including Select Chauffeurs Pty Ltd partners).


13. Damage to Vehicle


You are responsible for any damage to a vehicle caused by a passenger on your booking. You will
not be responsible for damage caused by the actions of us or any of our employees.


14. Right to Refuse Travel


We reserve the right to refuse travel or remove from the vehicle any passenger, where the
passenger:


• Behaves in a disruptive, threatening or unlawful manner and may pose a threat to themselves,
other passengers, Select Chauffeurs Pty Ltd staff or property;


• On our reasonable assessment, appears to be under the influence of alcohol or any other drug or
appears to be in possession of any unlawful substance;


• Is afflicted by an infectious disease that poses risks to other passengers;


• Is observed smoking or attempting to smoke a cigarette on board a vehicle, including any onboard
toilet facility;


• Fails to comply with any applicable laws, rules, regulation or order;


• Has previously breached our Terms and Conditions; or


• Fails to comply with these Terms and Conditions.The Company provides a transport booking and management service,

working closely with operators. The Company manages the booking process, allocation of bookings to service operators,
and the overall quality of the service provided to customers. Service operators are responsible for providing vehicles and

drivers fully compliant with the terms of their operating license and with the Company’s service quality standards.


15. Complaints and Issues


Any complaints must be made in writing in a speedy and timely manner, the Company will be
unable to accept any complaints or apply compensation for complaints received more than 30 days
after the date of travel. Any remedies or compensatory measures offered (if any) by the Company
are at the strict discretion of the management of the Company. The Hirer also agrees that in the
event of a dispute arising from a booking, a chargeback request will not be raised through the card
issuer or bank.


Any complaints regarding the condition of the vehicle supplied or its facilities should be supported
by photographic evidence. We are accredited through Transport for NSW as a Long Distance,
Tourist and Charter Service Accreditation no: 43143


16. Additional Charges and Surcharges


Unless it has been agreed otherwise, the hire price will not include tickets, admission charges,
ferries, road tolls, entry fees or parking. However, the Company may make these arrangements, on
request, on the Customer’s behalf and would do so acting as an agent for the Customer. This means
that any terms and conditions applicable to that transaction by that supplier (i.e., those relating to
payment, cancellation, refunds etc.) would be as binding on the Customer as if they had made these
arrangements directly. The Company will not enter into any arrangement on the Customer’s behalf
until payment from the Customer to the Company has been made.


Bonds: The Company may charge a refundable bond for hires it deems to be at risk of additional
charges and or damages. Examples: Weddings, Inbound overseas customers, Late night and/or party
related hires, etc.


Should the Customer be late for any pickup as set out in the Booking Confirmation the Hirer will be
liable for any additional costs incurred by the Company in providing the Service including, without
limitation, the costs of obtaining a replacement vehicle or service if the original becomes
unavailable, and obtaining additional Drivers.


17. Overtime charges:


If the vehicle departs within 10 minutes of the scheduled/confirmed pickup time no overtime
charges will be levied.


Any departures that take place 15 minutes or later than the scheduled/confirmed pickup time
overtime charges may be levied (from the scheduled/confirmed pickup time) at the following rates:


New South Wales, Victoria, Queensland, Tasmania, Western Australia, ACT & South Australia


It is NOT the responsibility of the driver or Company to inform or warn you or your group of any
impending charges including overtime, damage, or extra kilometres, etc, regardless of the
circumstances on the day of your journey. It is your responsibility to manage your group’s
requirements on the day and be aware of any extra charges that could be incurred.


Should the Customer not have arrived for the departure, the Company shall be relieved of any
obligation to provide the service and shall have no liability to the Customer for any costs incurred
by the Customer in completing their journey. Notwithstanding the foregoing, the Company shall use
reasonable endeavours to complete the journey at full cost to the Customer.


If there are extensive delays to the departure times, the Company cannot guarantee that it will be
able to fulfill the booking if vehicles are committed to other charters.


The Company reserves the right to charge for cleaning fees and damages to vehicles made by the
hirer and/or the passengers. Monies will be collected from the Hirer.


In addition, if actions by the hirer and/or the passengers mean that an upcoming journey is affected,
the hirer is liable for all costs involved. E.g., If the vehicle is soiled by the hirer and/or the
passengers and another vehicle is required to cover the following booking, then the party
responsible is liable for the cost of the new driver and vehicle in addition to the cleaning fee.


For some journeys, it may be necessary to accommodate the Driver, these costs will be borne by the
Hirer and will be paid in advance of the journey’s commencement. Where Driver’s accommodation
is arranged by the client, it must be a single occupancy room of a minimum 3.5-star standard with a
private bathroom and room for the vehicle to park. Driver meals are $25 per driver/per meal, three
meals per day on multi day journeys.


Any taxes or charges imposed by any Government or other authority which the Company is obliged
to pay in order to fulfil the booking will normally be included in the quotation or confirmed
booking price. However, if any such tax or charge is introduced or increased after the booking has
been made and before travel, the Company will pass that cost onto the Customer and the Customer
will be obliged to pay it prior to departure. Failure to make such requested payment will be regarded
as cancellation by Hirer.


18. Use of the Vehicle


The Hirer cannot assume the use of the vehicle between outward and return journeys nor will the
vehicle remain at the destination for the Hirer’s sole use unless this has been expressly agreed in
writing by the Company.


19. Route


Unless the hirer has advised of a particular route and specified it at the time of booking, the route
taken will be entirely at the discretion of the Company or Driver according to road, traffic and
weather conditions at the time of travel. The vehicle will depart at the times agreed by the Hirer at
the time of the Booking Confirmation; no price discount shall be given if the route chosen is not
actually the shortest. All pick-up and drop-off locations and routes of travel must be legal points for embarkation and
disembarkation and suitable for the vehicle utilised. Where that is not the case, the driver will
advise the client of the nearest pick-up or drop-off location that meets this requirement, or take the
route of travel required to meet this requirement.


Stops will be made at suitable points to satisfy legal requirements regarding breaks and rest for
Drivers. It is the Hirers’ responsibility to account for all passengers at those times. The Company
cannot accept liability for any losses incurred by passengers who fail to adhere to the Hirers’
instructions.


Any changes requested to the route by the Customer shall be at the Driver’s sole discretion and the
Driver may charge an additional fee if additional drop-off points are requested and agreed by the
Driver.


20. Change of Vehicle


The Company reserves the right to subcontract to another operator to perform the hire or to supply
replacement vehicles. If for operational reasons the Company is compelled to supply a larger
vehicle than required this will be at no extra charge (unless the number of passengers is increased
from the original booking).


20.1 Contractors


During peak times or on other occasions where our vehicles are at capacity, we may use the services
of other limousine companies. Although other companies will remain under our supervision, they
will be governed by their own operational guidelines and operate at all times under their own
insurance policies. Some remote/regional locations may also require the use of contractors.


21. Passenger Numbers


The vehicle supplied by the Company will take account the number of passengers specified at the
booking time. The Customer must ensure they specify the correct information at the time of the
booking and inform the Company as soon as possible if there are any changes.


22. Property & Baggage


The vehicles are subject to statutory safety restrictions on the carriage of luggage and the Driver has
sole authority to decide whether the property is suitable to be carried on that vehicle.


Our Baggage allowance policy is mandatory, for your safety and to meet legal requirements in the
safe transfer of passengers.


When the vehicle is fully occupied each passenger may carry:


One soft-sided overnight bag or suit sack, weighing no more than 5 – 10 Kgs.


Failure to notify the Company correctly of the nature of the journey will be construed as a breach of
contract and at the Company’s absolute discretion may lead to termination of the booking without
compensation or refund.


26. Force Majeure


Neither party shall be liable in damages or have the right to terminate this Agreement for any delay
or default in performing hereunder if such delay or default is caused by conditions beyond its
reasonable control including, but not limited to Acts of God, Government restrictions (including the
denial or cancellation of any export or other necessary license), wars, insurrections, strikes,
pandemics, including, without limitation, failure of suppliers, subcontractors, and carriers, bad
weather, and/or any other cause beyond the reasonable control of the party whose performance is
affected to substantially meet its performance obligations under this Agreement.


27. Driver’s Hours


Driver’s Hours (Fatigue Management) and rest periods are strictly regulated by Australian state and
federal government law and the Hirer accepts responsibility for timings agreed at confirmation of
booking. The Hirer accepts that neither they nor their passengers shall delay or interrupt the journey
in such a way as to cause the Driver to breach Drivers Hours regulations and must adhere strictly to
all collection times contained in the Booking Confirmation. If any breach is likely to occur the hirer
agrees to pay any additional costs incurred.


If delays occur for whatever reason, the Company may take whatever action is deemed necessary
for the Vehicle in order to comply with the law. Where delays do occur, the Company cannot be
held responsible for any losses arising as a result of those delays or non-performance of the services
unless they are due solely to the negligence of the Company.


28. Passenger Conduct


It is incumbent upon the Hirer and the Hirer’s party to behave in a proper manner for the duration of
their journey. The Driver is responsible for the safety of the vehicle and as such may refuse to allow
a passenger or passengers to board the vehicle or eject them from the vehicle if, in the Driver’s sole
discretion, the passenger is considered unfit to travel for whatever reason (for example, being
intoxicated, aggressive or abusive). The Driver may refuse to continue a journey if, in the Driver’s
sole discretion, considers any passenger to be behaving in such a way that may compromise the
safety of other persons, the contents of the vehicle or the vehicle itself.


In such event, at the Driver’s sole discretion, the journey may continue once the passenger or
passengers have been removed from the vehicle, but should passenger conduct result in summary
termination of the journey, the company reserves the right to cancel any other parts of a booking,
and in such circumstances the forfeiture of any monies paid, and no claims for compensation or
refund in either whole or part shall be considered.


Any damage caused to the vehicle by the Hirer or any of the passengers shall be the responsibility
of the Hirer and the Hirer shall be liable for all costs related.


N0 Alcohol, Tobacco or Drug Consumption


No open alcohol or glass products are allowed in the vehicle at any time.


All vehicles are strictly non-smoking by law.


Non-compliance with a Driver’s request for passengers to refrain from drinking alcohol, the
smoking of tobacco or consumption of illegal narcotics may result in summary termination of the
journey, cancellation of any other parts of a booking and, in such circumstances, the Hirer shall
remain liable for any sums due under this Agreement and the Company shall have no liability to the
Hirer and no refunds shall be provided.


29. Animals


With the specific exception of recognised assistance dogs, (which includes guide dogs), no animals
are permitted to be carried on any vehicle booked under the terms of this agreement, unless specific
permission has been obtained in writing from the Company prior to the commencement of any
journey.


The inclusion of this clause should not be taken to imply that permission will be given for the
carriage of animals other than recognised assistance dogs, and specific requirements may be given
with regards to restraint of aforesaid animals to ensure safe transit of any animals for which
permission is given. Failure to comply with any reasonable requirements may result in summary
termination of the journey, removal of the animal from the vehicle and additional charges for any
damages or mess left in the vehicle.


A recognised assistance dog is one that has been specifically trained to assist a disabled person and
that meets the accredited membership criteria of Assistance Dogs International/ANZAD, or other
such bodies as may from time to time be recognised. An assistance dog trained by a member of
Assistance Dogs International will have formal identification. Accredited Australian and New
Zealand assistance dog organisations can be found at the website address:

30. Limitation of liability


Subject to the remaining provisions of this clause, the Company’s liability to the Hirer under or in
connection with this Agreement for all and any direct loss or damage arising from any one incident
or series of connected incidents is limited to the booking value (excluding any additional Charges
arising by way of clause 6.


Neither the Company nor the Hirer excludes or restricts in any way its liability under or in
connection with this Agreement for death or personal injury caused by its negligence or to any
extent not permitted by law.


The Company shall not be liable to the Hirer (whether in contract, tort, under statute, for
misrepresentation or otherwise including in each case negligence) and whether or not the Hirer was
advised in advance of the possibility of such loss or damage, for:any of the following types of loss or

damage whether direct, indirect or consequential howsoever arising under or in connection with this

Agreement or any part of it: loss of profit, loss of revenue, loss of anticipated savings, loss of opportunity,

loss of business, wasted expenditure, loss from business interruption, loss or destruction of data, loss of

contracts, loss from expenditure of time by managers and employees, liability to third parties, pecuniary

losses arising from goodwill, or loss of or damage to goodwill; or any indirect or consequential losses whatsoever.


Nothing in this clause or in this Agreement excludes or limits the Customer’s liability to pay
(without set off) the charges or any Additional Charges.


31. Enforceability


If any provision or term of these Terms and Conditions shall become or be declared illegal, invalid
or unenforceable for any reason whatsoever, such term or provision shall be deleted but all other
terms will remain valid.


32. Governing Law


These terms and Conditions together with any Booking Confirmation shall be subject to and
construed in accordance with the laws of Australia. The parties hereby agree to submit to the
exclusive jurisdiction of the courts of New South Wales.


33. Covid-19


It is the responsibility of the Hirer to ensure all government laws, signage displayed, requests by the
Driver or Company and all procedures related to Covid-19 are adhered to. The Driver and Company
reserve the right to refuse entry or terminate a charter if any passengers are exhibiting symptoms
associated with COVID-19 and will not be liable for any costs associated with this.


We will require a passenger manifest with each passenger’s full name and contact number prior to
your departure in writing.


Where we have transported a passenger who becomes infected with Covid-19, the Hirer is
responsible for notifying the Company immediately.


The above Terms and Conditions still apply; however, our cancellation policy will differ with the
exception of COVID-19 related matters. Please see below:


A 100% refund will be issued when a cancellation of a booking is confirmed at a minimum of 7
days prior to your journey.


A 100% credit will be issued for cancellations that are confirmed 2-7 days prior to the journey. The
100% credit includes the 20% deposit which is normally non-refundable. The credit must be used
within 12 months of the issue date.


The event MUST be cancelled or a key person is unable to travel due to being affected by COVID
19 to receive the credit or refund. Select Chauffeurs Pty Ltd offers well above industry-standard

complimentary waiting time for all bookings.


34. Complimentary waiting time is applied as follows:


15 minutes complimentary waiting time at homes, hotels or other non-airport pickups.


30 minutes complimentary waiting time at Domestic Airport Terminals.


45 minutes complimentary waiting time at International Airport Terminals.


45 minutes complimentary waiting time at Cruise Ship Terminals.


Below waiting time rates apply to all major Australian cities.


Waiting time is charged in 5-minute increments once any complimentary waiting time has been
exhausted.


Below waiting time rates include GST.


Waiting time rates apply to ALL Select Chauffeurs Pty Ltd accounts, as well as individual bookings
via email, unless otherwise specified on your individual rate sheets and/or contracts.

35. Bookings:


35.1 General


These Terms apply to all orders unless otherwise approved by us (such approval not to be
unreasonably withheld). Any departure from and/or variation to these Terms stipulated in the order,
must be approved in writing by us in order to be binding on us. The order is considered as final only
after our acknowledgment of the order.


35.2 Subject and Limit of the Offer


These Terms apply exclusively to the supply of services specified herein and are not binding for
additional services. The Client will in no case be allowed to put forward standards, specifications,
statutes, rules and uses not duly accepted by us.


36. Responsibility


Except where we operate as the carrier or service supplier, Select Chauffeurs Buses and Limousines
acts only as agent for persons providing the services such as hotels, airlines, charter vessels, air
charter or venues etc. Except to the extent of any wilful, unlawful or negligent act or omission of
Select Chauffeurs Buses and Limousines, we accept no responsibility whatsoever in relation to the
provision or failure to provide those services.


36.1 Select Chauffeurs Buses and Limousines will not be liable, whether in tort, in contract or
otherwise for any accident, delay, injury, irregularity, loss or damage to persons or property of any
kind whatsoever and howsoever arising, caused or included during, or in relation to the carriage of
any passenger or provision of services, except to the extent that any wilful, unlawful or negligent
act or omission of Select Chauffeurs caused or contributed to the accident, delay, injury,
irregularity, loss or damage to persons or property.


36.2. The above provision shall be read subject to any implied terms, conditions or warranties
imposed by the Australian Consumer Law or any other Commonwealth or State legislation in so far
as such may be applicable and prevent either expressly or by implication the exclusion or
modification of any such term, condition or warranty.


36.3 All prices and conditions specified or described on the Select Chauffeurs Buses and
Limousines website or other publications and on the application, form are subject to change at any
time without notice.


37. Individual Events


37.1. Wedding, Limousine and Coach Reservation Confirmation


A deposit of 25% of the total amount payable for each booking may be required unless prior credit
arrangements have been made. Your reservation is regarded as confirmed once we receive your
deposit. The balance owing is due and payable 14 days prior to the date of your event.Credit card

details are required for all reservations and held as security against waiting time,
cancellation, no-show and vehicle damage etc. You will be notified of any additional payment
which may become due.


Cash payments will only be accepted prior to the hiring and direct debits must clear our account
before travel.


37.2 School Formals/Functions


A deposit of 25% of the total amount payable for each booking will apply. Your reservation is
regarded as confirmed once we receive your deposit. The balance owing is due and payable 14 days
prior to the date of your event.


Credit card details are required for all reservations and held as security against deposits, waiting
time, cancellation, no-show and vehicle damage etc. You will be notified of any additional payment
which may become due. Cash payments will only be accepted by prior arrangement with Select
Chauffeurs Buses and Limousines.


37.3 Cancellation School Formals/Functions/Weddings


Your deposit is NOT refundable if your booking is cancelled within 30 days of the booked date. The
total confirmed fee may be charged if the reservation is cancelled within 7 days of the booked date.
Cancellations MUST be made in writing (email or letter) by quoting your booking reference
number at least 14 days prior to the booked date.


38. Unforeseen Circumstances


We will make every effort to arrive at your collection and destination locations on time. However,
occasionally allowances must be made for unforeseen circumstances such as traffic, road and
weather conditions, illness, vehicle breakdown etc.


We cannot assume responsibility for circumstances beyond our control. Should there be a vehicle
breakdown or mishap rendering the reserved vehicle out of commission, we reserve the right to
substitute a vehicle/vehicle. We will make every effort to supply an alternate vehicle and advise you
prior to pick up.


Should we be unable to provide an alternate vehicle, a pro-rata refund may be paid. No guarantee
can be made that we will supply an identical vehicle.


39. Insurance


Our insurance policies cover our passengers whilst inside our vehicle/s and en route only.40. Safety Devices
Seatbelts are fitted to all our vehicles and must be used by all passengers whilst the vehicle is in
motion. Child restraints/booster seats must be used according to RTA and/or applicable State or
Territory authority guidelines. Use of the safety devices correctly will be the sole responsibility of
the passengers or passengers’ guardian/parent and/or the person or entity confirming the booking
or shown on our invoice.


41. Vehicle Restrictions and Road Rules


There may be instances where vehicles are unable to be negotiated over speed humps, through
turns, driveways, road closures etc., rendering some locations inaccessible. In this case, we will
endeavour to collect/deliver passengers at the closest possible point we can.


Should the chauffeur deem any location or situation unsuitable for the vehicle, an alternative will be
sought and used or termination of travel will occur if necessary - the chauffeur’s decision will be
final and no refund will be paid. Chauffeurs will adhere stringently to all legal road rules at all
times. All chauffeurs will plot his/her own travel route/s. When we follow your instructions for
collection or drop off and the vehicle becomes stuck/inoperative the cost of recovery will be passed
onto the booking person/company. Any damage caused to a private drive way/garden/ foot path or
road as a result of our vehicle and its size and weight will not be our responsibility. That should be
provided to our office in the form of pictures prior to the job taking place.


Please note that all Limousine/Bus/Coach bookings are subject to the vehicle being able to have
access to the itinerary provided to us. In the case where the vehicle is unable to access roads or a
particular location/venue required, the driver will pull up as close as possible at his discretion,
bearing in mind the client’s safety the driver’s safety and the safely of the Stretch limousines
vehicle is over 9.5 metres long and 2.1 m high. Our coaches are 12.3 metres to 14.5 metres in length
and stand 3.8 m in height. A double or triple axle coach can be over 22,000 kg in weight.

www.nhvr.gov.au The Heavy Vehicle National Law regulates heavy vehicles over 4.5 tonnes gross
vehicle mass in Participating states and territories.


42. Fuel Surcharges


From time to time, it may be necessary for Select Chauffeurs Pty Ltd Buses Coaches & Limousines
and /or its affiliates to charge a fuel surcharge in various locations. This surcharge may fluctuate and
is determined by world oil prices at the time and set by us. You will be advised of any additional
charges at the time of booking.


42.1 Variations


We endeavour to price all jobs/quotes on being given the correct information. Should there be any
changes to the scope of works then we will send you the difference in the actual job completed. One

such example is should the most direct route not be accessible due to land slide or flood for example
then we will need to recover the extra time fuel and wages by passing on this variation. We shall
endeavour to contact the booking person/company and should we have no communication then we
will proceed.


43. Communications


We endeavour to keep phone communication at all times. Should there be any black spots or phone
drop outs or lack of reception. It is the customers responsibility to supply us with additional contact
details and land lines. We are going off all instructions relayed to us prior to the job commencing.


44. Gratuities


In some locations gratuities and/or tipping are part of the general lifestyle and form part of the
worker’s wage. In these areas a gratuity is automatically added to the amount payable and can be
between 10 and up to 20% of the bill. In all other locations, gratuities/ service charges may be
included in the cost of the hiring or given voluntary for services rendered.


44.1 Tour Guides


We have coach captains that are tour guides giving commentary. We engage in external tour guides
and will supply you an invoice for their services and costings.

By using our websites and/or the individual client centre, you agree to these Terms. Your continued use of our
websites and/or their facilities constitutes your acceptance of these Terms. We believe that all
information contained within our websites is correct. However, we do not guarantee the accuracy or
reliability of the information given.


Select Chauffeurs Pty Ltd and its associated and/or related entities disclaim all liability and
responsibility for any direct or indirect loss or damage which may be suffered by any recipient
relying on anything contained in or omitted from our websites or publications.

46.2 Photos/Videos


All photos/images, artwork and logos of our vehicles are exclusive property of Select Chauffeurs
Pty Ltd and/or its associated companies. May be used for marketing or advertising and for security
purposes. They remain the property of Select Chauffeurs Group and will not be sold or distributed
without the company’s written consent.


47. Links


Any links to or advertisements on third party websites are not under our control. Please take note of
their terms and conditions and privacy statement. We do not take responsibility for the content on
third party sites or their policies. Permission is granted to link directly to our website on the
condition that the link name contains the words "Select Chauffeurs Pty Ltd " and that the link takes
viewers directly to our website.


48. Disclosure


We may be obliged to surrender your personal data to regulatory authorities and law enforcement
officials in accordance with applicable law. Personal information may be disclosed to identify,
contact or bring legal action against anyone damaging, injuring, or interfering with our rights or
property.


49. Security


We use industry standard encryption technology, so that the data passed between your browsers and
our websites is secure. All stored information is safely kept and can only be accessed by authorised
personnel. If you do not want information collected through the use of Cookies, please use your
browser to deny access.


50. Children under 16/Minors


We do not gather personal information from children. Website visitors 16 years of age and under are
required to have adult permission before submitting any personal information to us and/or our
website. When minors are traveling, we need it in writing to ensure we are sending a driver with
working with children. Including guardian or parents contact information.
